Your Website Safe and Fine-Free: Guide to Comply with Local and International Privacy Regulations

Today's websites are designed to offer a great user experience, encouraging potential customers to interact and explore what's on offer. This is achieved through tools such as contact forms, where users share their contact details , bank card details, location details, tax details, among others. Each visitor's IP address is also collected and this information is shared with third-party data analytics providers such as Google Ads, Google Analytics, Meta, and CRM providers, among others.

The collection of this personal information is subject to various privacy laws. In Mexico , for example, it is regulated by the Ley de Protección de Datos Personales en Posesión de Particulares. In the United States , there are multiple state privacy laws that can apply to companies regardless of their location, with fines for non-compliance that can start at $2,500 USD per violation. In Europe, compliance with the EU General Data Protection Regulation is required.

Even if your website was created in any other part of the world, when citizens of those countries visits your website, you will have to comply with the regulations.

WHAT IS A COOKIE POLICY AND COOKIE CONSENT BANNER?

Cookies are small pieces of code that are inserted into the user's browser and device when visiting a website. These cookies can ensure the proper functioning of the site ( essential and functional cookies ) or they can track visitors for analysis and advertising purposes ( marketing cookies ).

Several of the privacy laws we've already mentioned require users to give their consent before non-essential cookies are installed on their browsers. This is usually done through a cookie consent banner, which asks visitors to set their consent preferences. Failing to obtain consent for the use of non-essential cookies or third-party tracking technologies can result in significant fines and even lawsuits .

Since 2024, there has been an increase in lawsuits against website owners in the United States for violating the CIPA law, which requires consent from California visitors before tracking them with third-party technologies, regardless of the country the website is from . A comprehensive cookie consent solution helps owners comply with these laws, respecting visitors’ rights and reducing the risk of penalties.
